Reinstatement of a Revoked or Suspended Driver’s License

Your driver’s license may be revoked or suspended in Michigan for a lot of different reasons.  Some of these charges have set windows of time before you are allowed to have your license reinstated.  The Bennett Law Firm’s team is ready to assist you throughout your appeal process.  Contact us today for help getting back your driver’s license after having it revoked or suspended.

Implied Consent

In Michigan, when you are arrested for drunk driving, you are required to submit to a bodily alcohol content (BAC) test.  Under Implied Consent Law all drivers on Michigan roads have given consent to having the test administered to them simply for being out on public roads.  If you were pulled over for driving under the influence and refused to take the test offered at the police station you could be faced with having points added to your license or having your license suspended for one year.  Our team at Bennett Law can help you appeal the suspension to DAAD/DLAD (Driver Assessment and Appeal Division/Driver License Appeal Division) or even Circuit Court.  When facing this situation and we can help get you driving again.

Documentation Mistakes with Driver’s License Restoration

There are some common mistakes people make during the process to having their license restored.  It is important to plan for and prepare all the necessary documentation before the appeal hearing process.  A lot of the needed documentation comes through the Michigan Secretary of State’s office of DAAD/DLAD (Driver Assessment and Appeal Division/Driver License Appeal Division)  including a Request for Hearing form and a Substance Evaluation Form.  A common mistake people make is not completing all the required steps before submitting the request for the appeal.  As your legal representatives, we will make sure you have everything completed and that your forms are properly filled out before submitting your paperwork to the Office of Hearings and Administrative Oversight.  We will work with you to get you legally behind the wheel again as soon as possible.

Driver’s License Appeal Hearing Overview in Michigan

Getting your license back through DAAD/DLAD (Driver Assessment and Appeal Division/Driver License Appeal Division) is not always a quick process in Michigan.  It can take a while before your hearing will take place.  During this time, we will help you build the best defense possible before appearing at the hearing.  Each defense is different depending on the charges you received.  Our team has knowledge in all areas of driver’s license restoration from DWLS conviction (Driving While License Suspended) to drunk driving and drug convictions.  The Bennett Law Firm’s team is ready to help you build your defense today.

DAAD (Driver Assessment and Appeal Division) Hearing

The Michigan Secretary of State’s Driver Assessment and Appeal Division (DAAD) has Driver Assessment and License Appeal Offices across the state where your appealed case will be heard. Depending on your charges, you will need to provide different types of evidence when having your appeal heard.  For instance, if you were charged with alcohol or drug-related charges such as a DUI (Driving Under the Influence) or an OWI (Operating While Intoxicated), you will need to show that you have abstained from the use of these substances.  We will help you line up the necessary documentation to show you are no longer partaking in these substances and that you are no longer a danger to others when out on the road.

Driver Responsibility Fees

The Michigan Driver Responsibility Law required drivers to pay harsh penalties when their license was suspended.  As of October 1, 2018, those fees have been forgiven under changes to Michigan law.  Even if you owed fees prior to this date, you are no longer required to pay them and can have your license reinstated.  If you entered into a payment plan or a Work Force Training program to cover your fees but did not complete the plans outlined in your agreement contact us for guidance on how to get your license restored today.  As of January 1, 2019, there is a reinstatement fee of $125 that is required to be paid before your license can be restored.   As your Metro Detroit license restoration legal representation, we can help you figure out how to get your license restored.  We will help you determine if there are any other fees due such as a Failure to Appear in Court or a Failure to Comply with Judgment fee due which would be paid directly to an agency or to the court.

Out of State Driver’s License Restoration

If you had your license revoked or suspended in Michigan, but are no longer a resident here, you will not be able to get a license in a different state until your case is handled here.  We can help you obtain an Administrative Review of your case through DAAD/DLAD (Driver Assessment and Appeal Division/Driver License Appeal Division) and will be your representative in Michigan.  These hearings are held in several locations across the state, however, if you are not able to travel here we can help arrange for a video hearing.  We will go over with you all the paperwork that is required for the hearing including proof of your out-of-state residency.  Once the hearing is completed, you will still need to follow the required steps in your new home state to obtain a license there.
